Our terms and agreements, which govern the relationship between us, are made accessible here on our website.   • Submitting an application, resume, or contact form does not create an employment contract, independent contractor agreement, or any form of professional affiliation between you and Refiner.

  • An official affiliation with Refiner is only established upon the mutual execution of a formal, written Independent Contractor Agreement (ICA), and the successful transfer of your real estate license under Tennessee state regulations.

3. Accuracy of Information You Provide

You agree that all information you submit through the Site—including your name, contact details, employment history, and real estate license status—is true, accurate, and complete. Submitting false, misleading, or fraudulent information may result in the immediate rejection of your application or termination of any subsequent relationship with Refiner.

4. Intellectual Property Rights

All content on this Site—including text, graphics, logos, images, video clips, and software—is the property of Refiner or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws. You may view and download material from this Site solely for your personal, non-commercial use in exploring career opportunities with us.

  • Violate any local, state, national, or international law or regulation.

7. Limitation of Liability

To the fullest extent permitted by law, Refiner, its officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from your use of, or inability to use, this Site or the submission of your recruiting information.

8. Dispute Resolution and Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY HEAR YOUR DISPUTES.

  • Informal Negotiation First: Before initiating any formal legal proceeding, you and Refiner agree to attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Site, or your recruiting submission (a "Dispute") informally. You agree to send a written notice of your Dispute, including a description of the issue and your requested relief, to our contact address provided below. We will attempt to resolve the matter with you via email or phone within thirty (30) days of receiving your notice.

  • Binding Arbitration: If the Dispute cannot be resolved informally within thirty (30) days, you and Refiner agree that the Dispute shall be settled exclusively through binding, individual arbitration, rather than in a court of law. The arbitration will be administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules, which are available at www.adr.org. The arbitration shall take place in Davidson County, Tennessee, USA, unless you and we mutually agree on a different location or a virtual/telephonic hearing. The arbitrator's decision will be final and binding.

  • Class Action and Jury Trial Waiver: YOU AND WE AGREE THAT ANY ARBITRATION OR LEGAL PROCEEDING SHALL BE CONDUCTED INDIVIDUALLY AND NOT AS A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. This means you may only bring claims against us in your individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. Furthermore, you and Refiner waive any constitutional or statutory right to a trial by jury.

  • Exceptions to Arbitration: Notwithstanding the agreement to arbitrate, either party may bring an individual action in a small claims court (provided the claim qualifies) or seek injunctive or other equitable relief in a court of competent jurisdiction to stop the unauthorized use of the Site or the infringement of intellectual property rights.

9. Governing Law

These Terms and any dispute arising out of your use of the Site shall be governed by and construed in accordance with the laws of the State of Tennessee, USA, and operating under the laws of the USA, without regard to its conflict of law principles.
